Agreement for Travel Arrangements

Thank you for your interest in becoming a customer of Traveling Misfits LLC d/b/a Traveling Misfit Adventures (hereinafter “Agency”) Florida Seller of Travel Ref. No. ST15578 – CST 2090937-50. It is the policy of our business that a “Agreement for Travel Arrangement Consultation Services” is completed by all our clients. It sets the terms of engagement. Please read it and make sure you understand the scope of our engagement. I, the undersigned, (hereinafter “Client”) do hereby retain and employ the services of Agency to advise and assist me in connection with the following travel matters: Planning, making reservations and organizing travel to the desired destination.
Term of Agreement. This shall commence the date of execution shown below and run for a period of one year. Notwithstanding the foregoing, if the client uses Agency's services to make a confirmed travel reservations before the one-year anniversary for which this Agreement has been in effect, this Agreement will be deemed terminated on the date of the client's confirmed booking.
Fees and Expenses. Agency will be entitled to reimbursement for all costs and expenses incurred in making the agreed travel arrangements. Additionally, in order to perform the professional services required to plan and arrange your travel, a fee is required which is non-refundable. Vacation planning involves much time and my is based on years of personal experience and professional expertise. Your final itinerary and documents will give you as smooth a vacation as possible. All vacations arranged through the Agency shall receive a Fixed Consultation Fee of $200 appearing on your invoice for the travel consultant's time in planning, preparing, negotiating, booking travel and ground arrangements if trip is cancelled/postponed as outlined in the cancellations/postponement section of this agreement. The consultation fee will be charged to the card on file.
Cancellations/Postponements. Agency will hold the Fixed Consultation Fee open until the expiration of the term of this Agreement. The Fixed Consultation Fee applies to the use of Agency's consultative services for a single trip. Agency shall retain the entire Fixed Consultation Fee if my trip is: (1) not booked; (2) canceled or postponed beyond the expiration date of this Agreement; or (3) booked through another travel agency.
Travel Insurance. For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. Please note that most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy.
Credit Card on File. Client agrees to provide Agency with an active credit card number which Agency will keep on file and which will be used to process payment for any installment or unpaid balance on an invoice received by me. Agency will charge the credit card on file manually. By executing this agreement below, Client consents to any such Agency-initiated credit card transactions. Agency promises to keep such credit card information in a safe and secure physical or online location and to notify the cardholder immediately if it has knowledge of or suspects there has been a security breach.
Supplier Commissions. Client understands that Agency will receive commissions from many of the suppliers with respect to the travel reservations made for me and/or the group traveling with me, and those commissions are in addition to the Consult Fee I have agreed to pay as set forth above. Further, I understand that Agency is acting in a dual agency capacity, and I consent to that arrangement.
Travel Documents. Client agrees to review your itinerary and other travel documents for accuracy and to inform us promptly of any issues. The names on your documents must match your government-issued ID.
Entry & Re-entry Rules. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Make sure to note rules are subject to change whether your travels are foreign or domestic. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel.
Risks of Travel and Release. We assume no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at travel.state.gov, click on "Find International travel Information" then click on "Country Information", and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at cdc.gov/travel, then click on "Destinations" and scroll to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. You hereby expressly assume all of these risks and dangers, and you hereby expressly agree to forever release, discharge and hold us, and our agents, employees, officers, directors, associates, affiliated companies, guides, group leaders, and subcontractors harmless against any and all liability, actions, causes of actions, suits, claims, and demands of any and every kind and nature whatsoever which you now have or which may hereafter arise out of or in connection with these risks and dangers.
Dispute Resolution. The laws of Florida State govern the rights and obligations of the parties to this Agreement and the interpretation, construction, and enforceability thereof. I agree that any action or proceeding brought against Agency shall be brought solely in the courts of Florida State located in Hillsborough County. In the event any action or proceeding is initiated by me in an inappropriate venue, I agree to pay Agency's costs and reasonable attorney fees associated with defending such action or proceeding.
Waiver. The failure of any party hereto to enforce, at any time, any of the provisions or terms of this agreement shall not be construed to be a waiver of such provision or term, nor of the right of any party thereafter to enforce such term or provision.
Severability. If any term of this Agreement is to any extent illegal, otherwise invalid, or incapable of being enforced, such term shall be excluded to the extent of such invalidity or unenforceability. All other terms hereof shall survive and remain in full force and effect. Notwithstanding, to the extent permitted and possible, the invalid or unenforceable term shall be deemed replaced by a term that is valid and enforceable and that comes closest to expressing the intention of such invalid or unenforceable term.
Entire Agreement. This agreement constitutes the entire agreement between the parties and there are no agreements or understandings concerning such agreement which are not fully set forth herein.
